City of New London, issued on June 23, 2005, the U.S. Supreme Court issued an important, if very controversial, interpretation of the governments power of eminent domain, or the power of the government to take land from property owners. The power of eminent domain is granted to governmental bodies -- federal, state and local -- by the Fifth Amendment to the U.S. Constitution, under the simple phrase, ...nor shall private property be taken for public use, without just compensation. In simple terms, the government can take privately owned land, as long as the land will be used by the public and the owner is paid a fair price for the land, what the amendment calls, just compensation. Before Kelo v. City of New London, cities typically exercised their power of eminent domain to acquire property for facilities clearly intended for use by the public, like schools, freeways or bridges. While such eminent domain actions are often viewed as distasteful, they are generally accepted because of their overall benefit to the public. The case of Kelo v. City of New London, however, involved a new trend among cities to use eminent domain to acquire land for the redevelopment or revitalization of depressed areas. Basically, the use of eminent domain for economic, rather than public purposes. The city of New London, Connecticut developed a redevelopment plan city fathers hoped would create jobs and revive downtown areas by generating increased tax revenues. Property owner Susette Kelo, even after an offer of just compensation, challenged the action, claiming that the citys plan for her land did not constitute public use under the Fifth Amendment. In its decision in favor of New London, the Supreme Court further established its tendency to interpret public use as the much broader term, public purpose. The Court further held that the use of eminent domain to promote economic development is constitutionally acceptable under the Fifth Amendment. Even after the Supreme Courts decision in Kelo, the vast majority of eminent domain actions will, as they historically have, involve land to be used for purely public uses. Typical Eminent Domain Process While the exact details of acquiring property by eminent domain vary from jurisdiction-to-jurisdiction, the process generally works like this: The property owner is notified by mail and will soon be visited by a government employee, often a right-of-way agent, who will further explain why the owners property is needed.The government will appoint an independent appraiser to evaluate the land and come up with fair price to pay the land owner for his or her land -- the just compensation.The property owner and the government may negotiate to come up with a final price to be paid the property owner. In some cases, a judge or a court-appointed arbitrator will be called in to oversee the negotiation.The owner is paid the agreed price and ownership of the property is transferred to the government. Capital Punishment I strongly feel that capital punishment is essential in our legal system, as well as everyday life. Just as a toddler needs to be disciplined when he or she has a tantrum, a murderer needs to be punished for his or her actions. The death penalty solves many problems. It is a threat to any conspiring criminal-murderer. It promises the inescapable condition. It frees up jail space and cuts money spent on the inmate. The death penalty is also the closest thing to justice for the family and friends of the victim. If nothing else, capital punishment scares women and men of committing a serious crime that might put them on death row. If an individual knew he or she would definitely be put on death row, the individual might decide not to commit the crime. Although prison is made out to be a scary place, it could never repulse someone more than frying in the chair, dying of poison injection, or hanging. Why allow any vicious murderer the chance to escape prison and harm another person? People put an animal down once it has imperiled a human's life or safety. If humans are so concerned with their well being they ought to be guaranteed the same sanctuary from killers. Prisons, for the most part, are inescapable. Hamlet: Comparing Father and Son The play, Hamlet, by William Shakespeare, Hamlet was a man that looked up to his father throughout his life, during and after his father's death. The younger Hamlet tried to follow in his father's footsteps, but as much as they were alike, they were very much different. The man named Hamlet had a son named Hamlet and after everything was over, that is one of the few things that they had in common. King Hamlet and Hamlet compare in that they are both upset by the Queen’s marriage, they both hate Claudius, they are both brave, and they are both dead by the end of the play. They contrast in that while Hamlet’s father was king, Hamlet will never have the kingship, Hamlet does not leave a legacy and they die differently. Hamlet looked up to his father because he felt that he was a great leader and the bravest man that he knew, as Hamlet mentioned, "so excellent a king† (I. ii.149). He wanted to be so much like him, but couldn't because of a couple of barriers that he had to deal with. He became a lot like his father in the end. Hamlet was very disappointed with his life because he knew that becoming king was one thing that he didn't have in common with his father, because his stepfather was king, â€Å"married with my uncle, my father's brother" (I. ii. 151-2). Hamlet was very upset by his mother's marriage, and as he learns later, his father was as well, "It is not nor it cannot come to good: But break, my heart; for I must hold my tongue" (I. ii. 157-8). In my opinion, the answer is yes, because every individual lives his or her life in various experiences. Some people claim to know the absolute truth. Individuals based their truth on experiences and emotions and at times not logically consistent. When force fields such as emotions are present decisions are made then opinions are formed. For example, politics, I state politics because it never has a common ground. In politics you’re either Democrat or Republican, and both parties feel their plan is the absolute truth. As an American, we have the right to our own opinion but realize that our opinion is not the absolute truth. To make the statement that there is no absolute truth is invalid. Because one plus one does equal two so there is absolute truth which can be proven and understood. Is there such a thing as absolute truth? Yes, because of human conscience that â€Å"duty† within us that tells us that certain things are right and wrong. Therefore, our conscience let us know there is something wrong with pain, hunger, rape and makes us aware that love, peace, and charity are positive things for which we should strive for. In my opinion it so important to understand the concept of absolute truth in all areas of life this includes religion, because consequences exist in life for being wrong. For instance, a nurse can give a patient the wrong amount of a medication that can kill them; having an investment broker make the wrong monetary decisions can put you and your family in poverty; getting on the wrong bus will take someone where they do not wish to go; and dealing with an cheating spouse can result in the destruction of a family and potentially divorce. There are so many religions in this world that attempt to give their meaning and definition to absolute truth. Your existence is absolute truth which is simple. Through religion, mankinds seek God, we hope for the future, forgiveness of our sins, peace in the midst of struggle, and answers to our deepest questions. Religion is really proof that mankind is more thanjust a highly evolved creature.
